Doctors want $30 million verdict tossed
NEWS IN BRIEF — Posted June 18, 2007
Ohio doctors hope to overturn a $30 million jury verdict they say was influenced by misleading evidence that the plaintiff attorney presented in a medical liability case involving a man born with severe brain damage. The Ohio Supreme Court heard oral arguments in the case, McLeod v. Mt. Sinai Medical Center, in May.
Through a joint friend-of-the-court brief, the Ohio State Medical Assn. and the American Medical Association/State Medical Societies Litigation Center are asking the high court to order a new trial. The lawyer's exaggerated closing argument denied the defendant doctors a fair hearing, according to OSMA General Counsel Almeta Cooper.
An appeals court agreed that the damages were too high. It upheld the negligence portion of the verdict and found no misconduct by the lawyer.
