Wisconsin may expand doctor liability
NEWS IN BRIEF — Posted Feb. 8, 2010
Wisconsin physicians could face additional liability under legislation approved Jan. 19 by the state Senate.
The bill, which heads to the Assembly, would allow parents to sue for noneconomic damages if their adult child died because of medical negligence. Likewise, adult children could recover damages if their parents died due to medical negligence. A companion measure is making its way through an Assembly committee.
If approved, the bills would undo prior state Supreme Court rulings precluding such claims. The Wisconsin Medical Society has mounted opposition to the measures, which have drawn support from the trial bar.
