Appeals court won’t rehear ADA medical marijuana case
NEWS IN BRIEF — Posted Nov. 19, 2012
The 9th U.S. Circuit Court of Appeals threw out a lawsuit brought by a group of disabled patients charging that some California cities were violating the Americans with Disabilities Act by shuttering medical marijuana dispensaries. The ADA guarantees equal opportunity for disabled people in employment, public accommodations, transportation and government services.
The panel of the court said it sympathized with the disabled residents but said federal law does not include protections for users of an illegal drug. The plaintiffs requested that the full court take another look at the case, but judges in November declined to rehear the suit.
